Terms of Service for Tanarus

Welcome to Tanarus ("we," "us," or "our"), a platform that provides access to free and paid 3D models. These Terms of Service ("Terms") govern your use of our website and services (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

The name "Tanarus" is a trademark of Fermi Paradox Systems SRL, based in Barbaresco, Str. Terzolo 7, 12050 -- Italy.

1. Acceptance of Terms

By registering an account, downloading 3D models, uploading content, or otherwise using the Service, you confirm that you are at least 16 years old (or 13 years old with parental consent for users outside the EU). For users in the European Union, you must be at least 16 years old to use the Service without parental consent, in accordance with GDPR. For example, if you are 14 years old and reside in France, you must have parental consent to use the Service. If you are under 18, you must have parental consent to use the Service.

2. User Accounts

To access certain features of the Service, such as downloading or uploading 3D models, you must create an account. Your personal data provided during registration (e.g., username, email) will be processed in accordance with our Privacy Policy. Your email will be used for account verification, service notifications, and critical updates. You agree to:

• Provide accurate and complete information during registration (username, email, password).
• Verify your email address to activate your account.
• Keep your account credentials secure and not share them with others.
• Update your account information as needed. Changing your username is allowed only once, and changing your email address requires verification.

We reserve the right to suspend or delete accounts that provide false information or violate these Terms.

3. Use of the Service

The Service allows you to download free and paid 3D models for personal and commercial use, subject to the applicable licenses. Most models are licensed as Royalty Free, allowing personal and commercial use, but specific terms (e.g., attribution or restrictions on modification) depend on the model’s license. For details on CC-BY or other licenses, refer to creativecommons.org. You agree to:

• Use models in accordance with their licenses, which may require attribution (e.g., “Model by [Author], sourced from Sketchfab, licensed under CC-BY”).
• Not redistribute, resell, or share purchased or downloaded models outside the Service unless explicitly permitted by the model’s license.
• Not modify models if prohibited by their license (e.g., CC-BY-ND licenses prohibit derivatives).
• Not use the Service for illegal activities or to harm others.

Some models, such as those sourced from Sketchfab, require attribution in the format specified in the model’s description. You are responsible for complying with these requirements.

4. Content Submission

As a creator, you may upload 3D models to the Service. By uploading content, you agree to:

• Upload only models that you have created or have permission to distribute (e.g., models from Sketchfab with appropriate licenses and credits).
• Provide accurate attribution for models sourced from third-party platforms (e.g., “Model by [Author], sourced from Sketchfab, licensed under CC-BY”).
• Not upload models that infringe intellectual property rights, contain offensive, violent, or illegal content, or violate applicable laws.
• Allow Tanarus to review and moderate uploaded content to ensure compliance with these Terms.

You retain ownership of your uploaded models but grant Tanarus a non-exclusive, worldwide, royalty-free license to host, display, and distribute your models through the Service. Creators may receive a share (e.g., 50%) of the revenue from paid models, subject to our payment terms, which will be provided separately.

5. Payments and Refunds

Payments for 3D models are processed using Pi Network. Your payment information (e.g., Pi Network wallet address) will be processed in accordance with our Privacy Policy. You agree to provide accurate payment information for transactions. Currently, all purchases are final, and we do not offer refunds, except in cases of technical failures (e.g., if a purchased model cannot be downloaded due to a system error). For users in the European Union, a 14-day right of withdrawal may apply to digital content under the EU Consumer Rights Directive, unless you have expressly consented to begin downloading the content, waiving the 14-day withdrawal right. Refund requests must be submitted within 14 days of purchase for EU users, or 7 days for non-EU users. Refunds may be granted in exceptional circumstances, such as fraudulent transactions or undelivered content. Detailed conditions will be published in a separate Refund Policy, and users will be notified via email or a site announcement. 6. Intellectual Property

All 3D models and content on the Service are protected by intellectual property laws. You may not:

• Upload, download, or use content that infringes on intellectual property rights of others.
• Modify, reverse-engineer, or redistribute models unless permitted by their license.

If you believe content on the Service infringes your intellectual property rights, please contact us at privacy@tanarus.com with details of the alleged infringement. We will investigate and take appropriate action, including removing infringing content.

7. User Conduct

You agree to use the Service in a manner that is lawful and respectful. You may not:

• Post spam, offensive, or harmful content in profiles, comments, or other areas of the Service.
• Attempt to bypass security measures, hack, or disrupt the Service.
• Use the Service to distribute malware or engage in fraudulent activities.

You may report violations of these Terms by contacting us at privacy@tanarus.com. We will investigate reports within 7 business days and take appropriate action.

8. Termination of Access

We reserve the right to suspend or terminate your access to the Service if you:

• Violate these Terms.
• Engage in fraudulent activities, such as bypassing payment systems.
• Upload content that infringes on intellectual property rights or contains illegal material.

If your account is terminated due to a violation, you will not be entitled to a refund or access to previously purchased models.

9. Limitation of Liability

To the fullest extent permitted by law, Tanarus is not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to:

• Technical failures or interruptions in the Service.
• Loss of data or models due to system errors.
• Misuse of models by other users.

The Service is provided "as is" without warranties of any kind, express or implied.

10. Governing Law

These Terms are governed by the laws of Italy. Any disputes arising from these Terms or your use of the Service will be resolved in the courts of Italy.

11. Changes to These Terms

We may update these Terms to reflect changes in our practices or legal requirements. For significant changes, we will notify you:

• By email (sent to the address linked to your account) at least 30 days before the change.
• Via a visible notice on our website (e.g., pop-up or banner) upon your next login.

Minor changes, will take effect immediately without individual notifications. Your continued use of the Service after the notice period constitutes acceptance of the updated Terms.
